Navigating Utah’s Extended Summer Parent-Time Schedule

Child Custody

Summer is coming! This blog post will focus on the extended parent-time schedules set forth in Utah Code Ann.  § 30-3-35(4) and/or § 30-3-35.1(8). These extended parent-time schedules ensure both custodial and noncustodial parents have ample opportunity to spend quality time with their child(ren). Let’s delve into the specifics of Utah’s extended parent-time schedules as outlined in these statutes.

What is the Extended Parent-Time Schedule for Noncustodial Parents?

The statute(s) state: “For the four weeks of extended parent-time for a noncustodial parent [ ]: (i) two weeks, which may be consecutive, shall be uninterrupted parent-time for the noncustodial parent; and (ii) two weeks, which may be consecutive, may be interrupted by the custodial parent for a weekday visit on the same day on which the noncustodial parent is granted weekday day parent-time.”

Based upon these statutes, if you are the noncustodial parent, then you should be entitled to up to four weeks of extended parent-time with your child(ren) during the summer break. These four weeks can be exercised consecutively or non-consecutively.

During this four-week period, you will typically exercise two weeks of uninterrupted parent-time (i.e. no mid-week visit for the custodial parent) and an additional two weeks of interrupted parent-time (i.e. mid-week visit for custodial parent).

What is the Extended Parent-Time Schedule for Custodial Parents?

The statute(s) state: “A custodial parent is entitled to uninterrupted parent-time with the child for two weeks, which may be consecutive, when school is not in session for summer break.”

Based upon these statutes, if you are the custodial parent, then you will typically be entitled to uninterrupted extended parent-time with the minor child(ren) during the summer break for two weeks.

Conclusion.

Utah’s summer parent-time schedule offers a structured framework for custodial and noncustodial parents to spend quality time with their child(ren) during the summer break.
